New Delhi, May 20, 2023: In a significant development, the Supreme Court of India has directed the suspension of a scientific investigation into a disputed structure within the premises of the Gyanvapi mosque in Varanasi. The structure in question is claimed by Hindu plaintiffs to be a ‘Shivalinga,’ whereas the mosque committee asserts that it is a fountain. The apex court’s decision came in response to a special leave petition filed by the concerned parties.

A bench comprising Chief Justice of India DY Chandrachud, Justice PS Narasimha, and Justice KV Viswanathan deliberated upon the matter before passing the order. The court’s decision to put the scientific investigation on hold reflects the complexities and sensitivities surrounding the disputed site, which holds religious significance for both Hindus and Muslims.

The Gyanvapi mosque, situated near the revered Kashi Vishwanath Temple in Varanasi, has been a subject of contention for many years. Hindu litigants claim that the mosque was built upon the remains of an ancient Hindu temple. This claim has fueled a legal battle, and the scientific investigation was intended to shed light on the disputed structure’s historical and religious significance.

The Supreme Court’s decision to halt the scientific investigation is likely to invite varied reactions from different sections of society. While the Hindu plaintiffs may perceive it as a setback to their quest for establishing the presence of a Hindu temple beneath the mosque, the mosque committee and Muslim community may view it as a positive development in preserving the status quo.

Chief Justice DY Chandrachud, while pronouncing the order, emphasized the need for maintaining communal harmony and ensuring that religious sentiments are not hurt during the proceedings. The court’s primary concern appeared to be the potential for unrest and tension in the region, considering the sensitive nature of the dispute.

The bench has scheduled further hearings to deliberate on the matter in detail. It is expected that legal experts, historians, and archaeologists will be called upon to present their views and evidence regarding the disputed structure. The court will likely consider various factors, including historical documents, archaeological surveys, and expert opinions, in reaching a final decision.
